Terms & Conditions

1. Overview

The present Terms and Conditions are the basis of a contract between Salparo GmbH, registered office at Arenenbergstrasse 2, 8268 Salenstein, Switzerland and the customer.

The following terminology applies to these Terms and Conditions and all Agreements:
“Offer”, “Agreement”, “Booking Agreement” refers to the official contract between Salparo GmbH and the customer.
“Customer”, “Passenger”, “You” and “Your” refer to all the persons included in the contract.
“The Company”, “Ourselves”, “We”, “Our” and “Us”, refers to the company Salparo GmbH.
“Crew”, “Crew member” refer to employees of the company Salparo GmbH.
“Sailing trip”, “Trip”, “Holiday” refer to the yacht charter service, subject of the contract.
“Boat”, “Yacht” refers to the vessel of the contract.

The skipper in charge of a trip is the legal representative of Salparo GmbH, entitled to take decisions on behalf of Salparo GmbH.

 

2. Booking process
2.1. Booking directly with Salparo

The process of booking directly with Salparo is considered valid only with the use of the offer issued by Salparo. Every offer is bearing a unique reference number. With any payment using the respective reference number, the offer is considered as the booking agreement and the customer agrees to the Terms and Conditions of Salparo GmbH.

2.2. Booking through a 3rd party

Booking through a 3rd party provider (e.g. Travel agent, TripAdvisor, etc). The customer agrees to the Terms and Conditions of Salparo GmbH. In case of overlapping the Terms and Conditions of Salparo GmbH apply over those of the 3rd party provider.

 

3. Payments

In order to secure the booking the customer has two options:
1. A down payment of 40% of the total price
2. A down payment of 40% of the total price, split into two equal installments of 20% of the total price each. The second installment of the down payment is required within 30 days from the payment of the first installment. Failure in timely payment of the second installment is considered a cancellation by the customer.

Full payment up to 60 days before departure is required. Delayed full payment is considered automatically as a cancellation by the customer.

Salparo reserves the right to offer its customer(s) special payment terms. Such terms when included in the booking agreement apply over the terms of this paragraph, “Payments”.

All payments and refunds do not contain any interest.

All payments shall be made by bank wire transfer. For all bank transfers, the reference number of the corresponding booking agreement is required. All bank transfers must be made to the valid bank accounts of Salparo. For any bank transfer the customer takes full responsibility for conducting payments only to the following valid bank accounts of Salparo:

4. Costs

Any additional costs, beyond the ones included in the booking contract, such as extra activities, alimentation ashore and other personal expenses of the customer and any passenger in the customer’s party, must be covered by the customer.

The alimentation expenses for any of the crew members (i.e. skipper or/and hostess or/and cook), during the sailing trip, are not included in the price of the booking agreement and the customer is obliged to cover them.

 

5. Cancellation Policy

In case of mutual agreement to postpone a trip, no cancellation fees are charged.

5.1. Cancellation by the customer

In the event of cancellation of the trip by the customer, for any reason, the following cancellation policy will apply:

For cancellation announced 1 to 30 days prior to the departure, the total amount is due.

For cancellation announced 30 to 60 days prior to the departure, 50% of the total amount is due.

For cancellation announced 61 or more days prior to the departure, the down payment (40% of the total price or the amount paid till the time of the cancellation) is due.

Should the customer not appear on the date of departure and until 18:00 (local time) of the following day, without previous notice, the booking agreement is considered as canceled by the customer and the total amount is due.

5.2. Cancellation by Salparo GmbH

In the event of cancellation of the trip by the Salparo GmbH, the following cancellation policy will apply:

For cancellation announced less than 30 days prior to the departure, the customer is offered two options:
1. A rescheduling of the trip. No administration fees will be charged to the customer.
2. Refund of the total amount.

The costs that the customer has been charged for their transfer to the departure location are refunded only after the request by the customer. The request must be in written and within 10 days of the cancellation announcement. Respective legal receipts, invoices, or reservation confirmations must be presented and the reservation dates of the transport must be at least 1 day before the cancellation announcement.

For cancellation announced 30 or more days prior to the departure, the customer is offered two options:
1. A rescheduling of the trip. No administration fees will be charged to the customer.
2. A refund of the total amount paid to Salpro till that time.

The costs that the customer has been charged for their transfer to the departure location are not refundable.

 

5.3. Force Majeure

In the event of cancellation of the trip due to force majeure, the customer will receive a voucher in the value of 50% of the total amount paid till that time, in order to use it for a future booking with Salparo.

 

COVID-19 Booking Policy

Taking into consideration the uncertainty caused to our customer(s) by the COVID-19 situation, we have adjusted accordingly our Terms and Conditions.

As of October 17, 2022, and until further notice, the following applies over the “Payments” and “Cancellation Policy” terms and conditions.

In case that the customer(s) is/are unable to reach the base of their charter or to return to their country of residence due to restrictions set by the authorities of their country of residence or Greece, announced prior to the departure date, the following policies apply:

For all bookings, up to 30 days prior to the departure date, we offer our customer the option to cancel the trip with a refund of 60% of the total price.

The customer must request the aforementioned refund in writing and up to 30 days before departure. Afterward, the contract is deemed to be canceled by the customer and the total amount is due.

 

6. Amendments
6.1. Amendments by the customer

Amendments to any of the parameters of confirmed bookings that customers may wish to make are subject to Salparo being able to make and cater for. All changes will be subject to availability and will be made at Salparo’s discretion.

Customers must notify Salparo in writing of any wish for changes to a confirmed booking.

The charge of administration fees for changes is at Salparo’s discretion. The customer will be informed about any fees and any change to the booking must be mutually agreed upon before it will be considered confirmed.

6.2. Amendments by Salparo

Salparo GmbH, if considered necessary (mainly for safety reasons), reserves the right to replace the vessel at any time.

Salparo GmbH, if considered necessary, reserves the right to replace any of the crew members, mentioned in the booking agreement, without any price changes, and without any refund.

The check-in time, as mentioned in the offer at the “When & Where” section, is the local time at which the customer is allowed to enter the sailing vessel. Salparo reserves the right to change the check-in time at any time, within the date of the trip commencement, without prior notice and without financial compensation. In case that Salparo moves the check-in time to a later date, other than the date stated in the booking agreement, it is considered as a delay from the side of Salparo and the customer reserves the right to request a refund proportionally to the reduced duration of the trip.

Changes in the duration of the trip for more than 48 “forty-eight” hours from the side of Salparo, is considered as a cancellation by Salparo and the “Cancellation by Salparo GmbH” term applies. As an exception, the customer is given the option to accept a trip of reduced duration, with a refund proportional to the deducted duration of the trip.

 

7. Variations during the trip

In the event of trip interruption, or early termination, due to physical limitations of any of the crew members or due to technical issues and damages of the vessel, the customer reserves the right to request a refund proportionally to the reduced duration of the trip.

Salparo reserves the right to replace any of the crew members at any time of the trip, without prior notice.

For safety reasons, Salparo reserves the right to replace the sailing vessel at any time during the trip, with another vessel of the same type (monohull or catamaran), of the same length overall or longer, of the same year built or newer, without prior notice and without any financial compensation to the customer.

A responsible level of behaviour and consideration from all passengers and crew members is expected whilst onboard the yacht. Customers are liable for any damage or loss caused by them or by any passenger in their party, whilst onboard. If customers or any passenger in customers’ party are considered to be, in the skipper’s reasonable opinion, behaving in a manner which is likely to cause danger or distress to any third party or property, Salparo has the right to remove the passenger(s) involved from the vessel, without any further responsibilities towards the so removed passenger(s).

Salparo reserves the right to interrupt or terminate the trip, without any refund, if Force Majeure circumstances arise.

In the event of voluntary departure from the vessel of the customer or any passenger in the customer’s party, the booking agreement is considered canceled without any refund. Salparo will finance the return of the departed passenger(s) to the home port of the trip and has no further responsibilities towards the departed passenger(s).

8. Check-in/out Times

Check-in time is the time at which the customer can embark on the yacht, and the check-out time is the time at which the customer must disembark the yacht. The check-in time is usually between 17:00 to 19:00 on the Saturday of the commencement of the charter and the check-out time is at 09:00 on the Saturday of the termination of the charter, unless it is agreed otherwise, through the official offer.

The yacht must be at the port of disembarkation before 18:00, on the day before the check-out.

9. Official documents

A passenger list (with personal data such as name, passport number, date of birth, etc.) should be submitted prior to the trip. All passengers are obliged, for the entire duration of the trip, to carry a valid ID or passport.

All passengers must fill out the respective form that Salparo GmbH will provide them with prior to the departure date.

 

10. Insurance / Personal Liability

The customer should take full responsibility for any medical ailments, physical limitations, or mental disabilities that will affect their ability to participate in the trip and any additive activities. Salparo GmbH undertakes no legal or financial responsibility for any implication related to these issues.

Salparo GmbH takes full responsibility to cover the customer against any damage to the chartered vessel caused directly by any of the crew members.

 

11. Yachts, services, products, equipment

The pictures of yachts, the yacht specifications, and the inventory lists are provided by Salparo in good faith. However, such information is indicative and provided for general information purposes only. Salparo does not guarantee the accuracy of any yacht-related information.

Adding services and/or products and/or equipment, in addition to those included in the booking contract may impose extra costs to the customer.

 

12. Right to use photos and videos

Salparo uses the images of real people during their sailing holidays on Salparo advertising materials, promotional materials and general publicity. If a crew member or a photographer is taking photographs or video and you have an objection to these being used by Salparo in an aforementioned manner, please make your objection known at the time.

 

13. Data protection

Salparo collects and securely stores customers’ personal data. Salparo will use customers’ personal data for the purpose of order processing, administration, host mailing, marketing and statistical analysis. Salparo may disclose such information to its service providers for these purposes and only. You have the right to request Salparo for a copy of your personal data that Salparo holds and to correct any information you believe is incomplete.

 

14. Weather Conditions

Should the weather not permit departure, as this is subject to the skipper’s judgment, no refunds are subjected to any delays or plan changes.

 

15. Sailing Diaries

Salparo may send to its customers an email series with information and articles about sailing holidays, sailing experiences, promotions, discounts and other Salparo offers. The name of this email series is “Sailing Diaries”. Customers can exclude themselves from receiving this email by clicking on the corresponding link at the bottom of the email.
